Section 1

Short title, extent and commencement.

Section 2

Definitions.

In this Act, unless the context otherwise requires,-
Section 3

Constitution of National Commission for Backward Classes.

Section 4

Term of office and conditions of service of Chairperson

and Members. Provided that no person shall be removed under this clause until that person has been given an opportunity of being heard in the matter.
Section 5

Officers and other employees of the Commission.

Section 6

Salaries and allowances to be paid out of grants.

TheĀ salaries andĀ allowancesĀ payableĀ toĀ theĀ ChairpersonĀ andĀ MembersĀ andĀ the administrativeĀ expenses, including salaries, allowances andĀ pensions payable to the officers and other employees referred to in sectionĀ 5, shallĀ beĀ paid out of the grants referred to inĀ sub-sectionĀ (1)Ā of section 12.
Section 7

Vacancies,ĀĀ etc., not to invalidate proceedingsĀĀ ofĀĀ

the Commission.Ā No act or proceeding of the Commission shall be invalid on the ground merely of the existence of any vacancy or defect in the constitutionĀĀ of the Commission.

Procedure to be regulated by the Commission.

FunctionsĀ of the Commission.

PowersĀĀ ofĀĀ the Commission.

TheĀ CommissionĀĀ shall,ĀĀ whileĀ performingĀ its functions under sub-section (1) of section 9, haveĀ allĀ theĀ powersĀ ofĀ a civil court trying a suitĀ andĀ inĀ particular,Ā inĀ respect of the following matters, namely:-

Periodic revision of lists by the Central Government.

Section 12

Grants by the Central Government.

Section 13

Accounts and audit.

Section 14

Annual report.

The Commission shall prepare, in such formĀ andĀ atĀ suchĀ time,Ā for each financial year, as mayĀ beĀ prescribed,Ā itsĀ annualĀ report,Ā giving a full account of itsĀ activitiesĀ duringĀ theĀ previousĀ financialĀ year and forward a copy thereofĀ toĀ theĀ CentralĀ Government.
Section 15

Annual report and audit report to be laid before

Parliament.Ā The Central Government shall cause the annual report, together withĀ aĀ memorandumĀ of action taken on the advice tendered byĀ theĀ CommissionĀ under section 9 and the reasons for the non-acceptance, if any, of anyĀ suchĀ advice, and the audit report to be laid as soon as may beĀ afterĀ they are received before each House of Parliament.
Section 16

Chairperson, Members and employees of the Commission to

be Public servants.Ā The Chairperson, Members and employees of the Commission shall be deemed to be public servants within the meaning of section 21 of the Indian Penal Code (45 of 1860).

Power to make rules.

Section 18

Power to remove difficulties.

Provided that no such order shall be made after the expiry of a period of two years from the date of commencement of this Act.

Repeal and saving.
